Colbert’s Concluding Cartoon Copyright Contravention Content

As noted here yesterday Lee Mendelson Film Production is suing entities that illegally used recordings of Vince Guaraldi music specifically created for Peanuts specials.

Part of Stephen Colbert’s finale last night included his band playing Peanuts music with Colbert then worrying whether that would incite a lawsuit against CBS. At the three minute ten second mark below.

Stephen Colbert toyed with saddling CBS with a copyright lawsuit, a roundabout dig at the network that said it canceled his show for financial reasons, by setting up to have The Late Show’s in-house band play the Peanuts theme song, “Linus and Lucy.”

Note from a non-attorney bystander: It is my understanding that playing a live version of the Peanuts theme music is a whole different situation than playing the copyrighted recorded music without permission.

  1. That is objectively hilarious. I appreciate the pettiness of the departing jab.

    And my non-attorney bystander opinion is the same as yours: as long as Colbert’s show paid a performance licensing fee to ASCAP, BMI, or somesuch, they’re in the clear.

  2. The joke was that CBS, not (The) Late Show, Inc. would be liable for the licensing fee.
